Terms and Conditions NOMB Changes
1. Membership
By signing or submitting our membership form, whether online or in paper form, you:
- apply for membership in the Asociación cultural-deportivo NOMB Changes (hereinafter referred to as NOMB Changes),
- acknowledge our association’s statutes as well as these terms and conditions,
- agree that your personal data will be stored and processed in accordance with our privacy policy. Photos and video recordings in which you are recognizable may be used for association purposes and published on our website, social media, and printed materials. We may also send newsletters and other information to the email address you provided during registration. You can revoke this consent at any time by sending us written notice, effective for the future,
- commit to upholding values of diversity, democracy, respect, solidarity, and tolerance while opposing extremism,
- confirm that you are at least 18 years old.
Membership Fee and Validity
The membership fee depends on the selected option and the current membership rates: https://nombchanges.com/join-us/.
Membership is valid on a calendar-year basis.
- If membership is completed by October 31, the full annual fee for the current year is due, and membership applies to the current calendar year.
- If membership is completed on or after November 1, the full annual fee is due, and membership applies to both the current and the following calendar year.
Membership becomes valid only after the application form (online or in paper form) has been fully completed and submitted, and the payment has been received in our account. You will receive a confirmation of your membership via email.
We reserve the right to reject membership applications if they do not align with these terms and conditions or our goals and values. In such cases, the membership fee will be refunded.
During the validity of a regular membership, members are entitled to participate in and vote at the association’s general meetings.
Termination of Membership
Membership is valid on a calendar-year basis and will automatically renew for another year unless it is terminated in due time. The payment request for the current year will be sent in January.
To terminate your membership by the end of the year, a written cancellation must be submitted by November 30.
Cancellations must be sent exclusively via email to hello@nombchanges.com, with the subject line: Membership Termination.
2. Donations
General Donations
Donations can be made via our donation form: https://nombchanges.com/free-donation/ at one of our on-site projects, via bank transfer, or through PayPal.
Acceptance of Donations
At NOMB Changes, we deeply appreciate your support. However, we reserve the right to accept donations only if they align with our goals and mission.
Use of Donations
Currently, NOMB Changes collects only unrestricted donations, allowing us to allocate funds flexibly and support as many projects as possible. To provide transparency on how we use donations, you can find details on our individual project pages as well as in our annual Impact Report.
Tax Advice
At this time, NOMB Changes cannot issue tax-deductible donation receipts. For cash donations, you will receive a simple donation receipt. For bank transfers, we can issue a donation receipt upon request. However, these receipts are not officially recognized for tax purposes. We do not provide tax advice regarding donations—please consult your tax advisor or another professional for appropriate guidance.
If you wish to donate more than €400 or make a corporate donation, please contact us in advance.
No Referral Commissions
We do not pay commissions or referral fees to third parties for directing donations or donors to us.
By making a donation, you agree to our privacy policy.
3. Participation in a NOMB Changes Project
If you participate in a project organized or significantly supported by NOMB Changes as a supporter, volunteer, or participant (hereinafter collectively referred to as “participants”), you confirm by agreeing to participate that you have been informed by NOMB Changes about the nature and process of the project (e.g., a surf coaching session, a surf trip, or another activity).
In this context, we inform you that participation in the project is generally at your own risk. You declare that you are physically capable of engaging in sports activities and that you can swim for at least 15 minutes in open water. Activities specifically designed for individuals with physical impairments are exempt from this requirement. In such cases, a discussion will be held in advance about the risks involved and the safety measures in place. If you decide to participate, you do so at your own risk.
By confirming your participation, you also agree not to be under the influence of drugs or alcohol for the duration of the project.
Furthermore, NOMB Changes advises you that access to surf spots or the ocean may be slippery, steep, or obstructed, and you acknowledge the associated risks.
You release NOMB Changes from any liability for personal injury, except in cases where damage results from intentional or negligent breaches of duty by NOMB Changes or its legal representatives.
You accept responsibility for any damage to NOMB Changes property caused by your actions. You understand that, at the discretion of NOMB Changes, you may be held liable for such damages.
Additionally, you agree that your personal data will be stored and processed in accordance with our privacy policy.
Photos and video recordings taken during the project in which you are recognizable may be reproduced, shared, and used free of charge by NOMB Changes for documentary and marketing purposes in audiovisual, print, and online media. NOMB Changes will not intentionally use images that could be perceived as offensive. Photos taken by participants and provided to NOMB Changes may also be used free of charge for promotional purposes.
NOMB Changes may send newsletters and other information to your email address. This consent is valid indefinitely but can be revoked at any time. The revocation must be submitted in writing and takes effect on the date of receipt.
Booking
You can book your participation in a project through the forms on our website (binding), via email, or by phone. If the booking is made by phone or email, we will send you a booking form via email. Once the completed form is returned, the booking becomes binding. Bookings are processed in the order in which they are received.
For participants under the age of 18, the consent and signature of a legal guardian or an authorized representative are required.
Payment
The following payment terms apply to our activities:
Single-Day Activity
- A 30% deposit is required upon booking to secure your reservation.
- The remaining amount is due on the day of the activity.
Trips / Multi-Day Activities
- A 30% deposit is required upon booking to secure your reservation.
- For trips within the EU, the remaining balance is due 30 days before departure.
- For trips outside the EU, the remaining balance is due 60 days before departure.
Payment terms may vary for specific projects. If this applies, you will be informed accordingly in connection with the respective project.
Cancellation Policy
By Participants
While we value the relaxed and flexible nature of the surf community, we must handle cancellations in a business-like manner.
A cancellation not only impacts our budget as a small non-profit organization but, depending on the project, also affects our business partners, including small local surf schools, other associations, independent surf coaches, and local rental providers.
If a project has specific cancellation policies differing from the ones below, you will be informed in connection with that project.
Single-Day Activity
You may cancel your single-day activity at any time by phone or email. The following cancellation fees apply:
- Up to 31 days before the activity: 30% of the total amount
- Up to 15 days before the activity: 50% of the total amount
- Up to 8 days before the activity: 80% of the total amount
- Thereafter: 100% of the total amount
Trips / Multi-Day Activities
You may cancel your booked trip or multi-day activity at any time by phone or email. The following cancellation fees apply:
- Up to 60 days before departure: 30% of the total amount
- Up to 30 days before departure: 80% of the total amount
- Thereafter: 100% of the total amount
We strongly recommend purchasing travel insurance that covers unforeseen events such as job loss, injuries before the trip, or natural disasters. Thank you for your understanding!
Cancellation by NOMB Changes
We reserve the right to cancel a project due to force majeure, natural events, other unforeseen circumstances, or unreasonable risks for participants. In such cases, we will inform you in a timely manner via email or phone. Depending on the type of project and the reason for cancellation, you will be offered one or more of the following options:
- A full or partial refund of the amount already paid
- Rebooking to a different date
- A voucher
Entry Requirements: Passports, IDs, and Visas
It is the participant’s responsibility to ensure they have a valid ID card or passport, as well as any required visas. Before the trip, we will provide information on necessary visas or other entry requirements and assist with relevant details on the application process. However, if you are unable to meet the entry requirements, NOMB Changes cannot be held responsible.
4. General Provisions
If any provisions of these Terms & Conditions are found to be wholly or partially invalid or unenforceable, the remaining provisions shall remain in effect. Insofar as a provision is invalid, the content of these Terms & Conditions shall be governed by the applicable legal regulations. The invalid provision shall be replaced by a legally permissible regulation that comes closest to what the parties originally intended in terms of origin, meaning, and purpose. This also applies to any potential gaps in these Terms and Conditions.
